Terms of Service

These Terms of Service ("Terms") govern your use of LevelGrid, the website at levelgrid.app and the product behind it (together, the "Service"). LevelGrid is operated by 49.336.992 LEO NASCIMENTO MULLER DOS ANJOS, CNPJ 49.336.992/0001-11, based in São Vicente – SP, Brazil ("LevelGrid", "we", "us").
By creating an account or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you use LevelGrid on behalf of a studio or another organization, you agree to them for it and confirm you have the authority to do so — "you" then means both of you.
1. The Service
1.1 What LevelGrid is. A product development tool for game studios: issues, projects, objectives, documents and whiteboards, organized by game and by team — and, when a studio connects one, the feedback, suggestions, bugs and playtests of its Discord server.
1.2 Your account. You must be at least 13 years old, and old enough to agree to these Terms where you live. Keep your account details accurate and your password to yourself: you are responsible for what happens under your account. Tell us at once if you think someone else used it.
1.3 Studios and members. A studio's owners and admins decide who joins its workspace, which games each member sees and what they can do there. The studio is responsible for how its members use LevelGrid.
1.4 Changes to the Service. We keep improving LevelGrid, so features may be added, changed or removed. Features marked as early or beta are offered as they are, and may change or end.
2. Acceptable use
2.1 What you will not do. You will not use LevelGrid to:
- break the law, or infringe anyone's intellectual property, privacy or other rights;
- upload malware, or anything meant to harm the Service or other people;
- access accounts, workspaces or data that are not yours, or get around a permission or a limit;
- probe, scan or test the Service's security without our written permission, or put an unreasonable load on it;
- copy, resell or reverse engineer the Service, except where the law allows it;
- send spam, harass anyone, or collect data from the Service by automated means other than the features and connections we provide.
2.2 Discord. Add the LevelGrid bot only to servers you run, or that you are allowed to add it to, and follow Discord's Terms of Service and Developer Policy. Tell your community what the bot collects and why — your server's rules or a pinned message are good places for it — and use your players' data only to run your game and its community.
2.3 Enforcement. We may remove content that breaks these rules, or suspend the account behind it, and we will tell you when we can.
3. Third-party services
LevelGrid works with services we do not control: Discord, the AI apps you connect, and the providers listed in our Privacy Policy. Their own terms govern your use of them, and we are not responsible for them. A feature that depends on one may stop working if that service changes or becomes unavailable.
An AI app you connect acts as you: what it reads from your studio's workspace goes to that app's provider, and what it changes is changed in your name. Your studio decides whether its members can connect AI apps, and whether they may only read or also write.
4. Plans and payment
4.1 Free plan. Every studio starts on the Free plan, with the limits shown on our pricing.
4.2 Paid plans. Paid plans are priced in US dollars, per user, as our pricing shows. Billing is not switched on yet: no one is charged until it is, and until they choose a paid plan.
4.3 When billing starts. Paid plans will be billed in advance for each period, plus any applicable taxes, and renew until cancelled; a cancellation takes effect at the end of the period already paid. We will announce price changes at least 30 days ahead. Except where the law requires otherwise, payments are not refundable.
5. Your content and your data
5.1 It is yours. You keep every right to what you and your studio put into LevelGrid — your workspace's content, your files, and what your players send through the Discord bot ("Your Content").
5.2 What you allow us to do with it. You give us a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit and display Your Content only as needed to provide, secure and support the Service, and to do what you ask it to do. We may use aggregated data that identifies neither you nor your studio to understand and improve LevelGrid.
5.3 Your responsibility. You are responsible for Your Content, and for having the rights and the legal basis to put personal data into LevelGrid — your players' included. For that data, your studio is the controller and we process it on your behalf, as our Privacy Policy describes.
5.4 Deleting and exporting. You can delete content at any time, and a studio can find and delete everything that came from one player. To get a copy of your data, or to delete your account, write to privacy@levelgrid.app.
5.5 No AI training. We do not use Your Content to train AI models.
6. Feedback
If you send us ideas or suggestions, we may use them with no obligation to you.
7. Our intellectual property
LevelGrid — its software, its design and its brand — belongs to us and to our licensors. These Terms give you the right to use the Service as they describe, and nothing more.
8. Term and termination
8.1 You. These Terms apply while you use LevelGrid. You can stop at any time, and ask us to delete your account.
8.2 Us. We may suspend or end your access if you seriously or repeatedly break these Terms, if the law requires it, or if your use puts the Service or other people at risk. We will give you notice when we reasonably can.
8.3 What happens then. Your right to use the Service ends, and we delete your data as our Privacy Policy describes. Sections 5.3, 6, 7 and 9 to 12 continue to apply.
9. Warranties and disclaimers
We work to keep LevelGrid available, secure and correct. To the extent the law allows, however, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not promise it will be uninterrupted or free of errors. Nothing in these Terms limits rights you have under consumer protection law that cannot be waived.
10. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim about the Service is limited to the greater of what you paid us in the 12 months before the claim and US$100. These limits do not apply where the law does not allow liability to be limited, such as for willful misconduct or gross negligence.
11. Indemnification
You will defend and indemnify us against claims by third parties arising from Your Content, from your use of LevelGrid in breach of these Terms, or from your violation of the law or of someone else's rights — including claims about your players' data.
12. General
12.1 Governing law and venue. These Terms are governed by the laws of Brazil. Disputes go to the courts of São Vicente, São Paulo, Brazil, except where consumer protection law gives you the right to bring them where you live.
12.2 Changes to these Terms. We may update these Terms. We will change the effective date at the top and, for significant changes, tell you at least 30 days ahead, by email or in the product. If you keep using LevelGrid after a change takes effect, the updated Terms apply.
12.3 Assignment. You may not transfer these Terms without our consent. We may transfer them as part of a merger, an acquisition or a sale of assets.
12.4 Entire agreement. These Terms and our Privacy Policy are the whole agreement between you and us about LevelGrid.
12.5 Severability and waiver. If a provision is found unenforceable, the rest stays in effect. Not enforcing a provision is not giving it up.
12.6 Notices. We send notices to the email address of your account; send yours to privacy@levelgrid.app.
12.7 Force majeure. We are not responsible for failures caused by events beyond our reasonable control.
